Note: Memorandum M-10-12 was issued in accordance with the permanent injunction that the District Court issued on March 10, 2010. On April 21, 2010, the United States Court of Appeals for the Second Circuit granted the Government’s motion for stay pending appeal of the District Court’s decision enjoining enforcement of various ACORN-related appropriations provisions. Accordingly, under the Second Circuit’s stay order, the enacted restrictions on funding ACORN and affiliates that were contained in the various FY 2010 appropriations bills remain in force during the pendency of the stay.
